Evers v. Marklein was accepted for original action by the Wisconsin Supreme Court in October 2023, bypassing Wisconsin’s circuit and appellate courts. This case broadly challenges the constitutional authority of legislative committees, like the Joint Committee for Review of Administrative Rules (JCRAR), to veto executive actions, including administrative rules.
AIA Wisconsin is monitoring this case as JCRAR has significant influence on the adoption of proposed building code changes that come before it for consideration. The final court decision, which is expected to be released no later than June 30, will rule on the authority between the executive and legislative branches, potentially impacting the JCRAR future's role in determining building codes.
